Terms of Service
1. Acceptance of Terms
These terms govern your use of the website at www.retainingwalltoowoomba.com.au and any enquiry you submit through it. By using this site, submitting an enquiry, or engaging with our AI concierge, you agree to these terms. If you do not agree, please do not use the site.
2. About Our Service
Retaining Wall Toowoomba is a lead-generation service that connects property owners across Toowoomba and the wider Darling Downs with our network of qualified retaining wall contractors. We do not perform construction work directly. We do not employ the builders in our network. Our role is to gather your enquiry, match you with one or more suitable network builders, and pass your details so they can prepare a quote and arrange a free on-site assessment.
3. General Information Disclaimer
This website provides general information only and does not constitute building, engineering, or legal advice. Retaining Wall Toowoomba connects property owners with our network of qualified retaining wall contractors. We do not perform construction work directly. All network partners are responsible for their own licensing, insurance, and work quality.
Information on this site about council approvals, building standards, drainage detailing, AS 4678, and material specifications is general guidance only. Verify your specific situation with the Toowoomba Regional Council, a structural engineer, or a QBCC-licensed contractor before engaging in any retaining wall work. Prices and lead times mentioned on the site are typical ranges based on industry data, not fixed quotes. Your actual quote will depend on your site, materials, access, drainage, and approvals.
4. AI-Powered Concierge: Recording, Transcription and Consent
By interacting with the AI-powered concierge widget on this site (text chat, or voice if enabled), you acknowledge:
- You are speaking with an automated AI system, not a human, until you are explicitly transferred or called back by a person.
- Chats and any voice interactions may be recorded and transcribed for quality, training, and compliance purposes.
- Where recording requires consent under your state's law, the AI will state at the start of the interaction that the conversation may be recorded. If you do not consent, you can end the chat or call and we will not retain a recording.
State-specific recording consent: Australian states differ on recording consent. NSW, QLD, WA, and the NT permit one-party consent (caller awareness is sufficient). VIC, SA, and TAS require all parties to consent before recording. Our AI opener identifies itself and discloses recording in all interactions regardless of state, so the higher standard is applied across the board.
You may opt out of the AI concierge at any time by ending the chat, closing the widget, or contacting us via the standard form on this site.
5. Your Obligations
When you submit an enquiry or engage with the concierge, you agree to:
- Provide accurate, current, and complete information about yourself and your retaining wall project.
- Use the site only for genuine enquiries about retaining wall work in Toowoomba or the surrounding Darling Downs.
- Not use the site or the concierge for any unlawful purpose, to harass any party, or to submit false or misleading enquiries.
- Take your own steps to confirm that the quotes, materials, drainage detail, approvals, and lead times proposed by a network builder are suitable for your specific site and circumstances.
6. Limitation of Liability
To the maximum extent permitted by law, Retaining Wall Toowoomba is not responsible for:
- The workmanship, materials, conduct, pricing, scheduling, or warranty handling of any builder in our network. Each network builder is a separate business responsible for its own work, licensing, insurance, and obligations to you.
- The accuracy or completeness of pricing ranges, lead times, council approval guidance, or material descriptions on this site, all of which are general information only.
- Any outcome that depends on factors beyond our control, including weather, site conditions, soil behaviour, material availability, council approval timelines, or third-party services.
Australian Consumer Law: nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or any other applicable law that cannot be lawfully excluded. Where our liability cannot be excluded but can be limited, our liability is limited at our option to re-supplying the service or paying the cost of re-supply.
